The Senate has rejected a proposal to make the electronic transmission of election results mandatory, voting against an amendment to Clause 60(3) of the Electoral Amendment Bill.
The rejected amendment sought to compel presiding officers of the Independent National Electoral Commission (INEC) to electronically transmit polling unit results to the INEC Result Viewing (IREV) portal in real time.
Under the proposal, results would have been uploaded after being entered on Form EC8A, duly signed and stamped by the presiding officer and countersigned by party agents.
However, lawmakers declined to adopt the amendment, opting instead to retain the existing provisions of the Electoral Act.
The current law grants INEC the discretion to determine the mode of result transmission, stating that “the presiding officer shall transfer the results, including the total number of accredited voters and the results of the ballot, in a manner as prescribed by the Commission.”
By rejecting the amendment, the Senate effectively preserved INEC’s authority to decide whether results are transmitted electronically or through other means, rather than making uploads to the IREV portal a statutory requirement.
