A couple from Orlando, Florida, has filed an emergency lawsuit against a fertility clinic after a DNA test revealed that their newborn daughter is not genetically related to either of them, allegedly due to a mix-up during an in-vitro fertilization (IVF) procedure.
The couple, identified in court documents as John and Jane Doe to protect their privacy, is suing IVF Life, Inc., also known as the Fertility Center of Orlando, and its physician, Dr. Milton McNichol. They claim the clinic mistakenly implanted an embryo that did not belong to them.
According to the lawsuit, the Does created three embryos using their own eggs and sperm. One embryo was implanted into Jane Doe in March 2025, and she later gave birth to a baby girl, Baby Doe, on December 11, 2025, following a full-term pregnancy.
Concerns reportedly arose after the child was born with physical characteristics that did not resemble either parent. Genetic testing later confirmed that Baby Doe shares no biological connection with John or Jane Doe, according to a report by ABC 7 Chicago.
Despite forming a strong emotional bond with the child, the couple says they believe Baby Doe should legally and ethically be raised by her biological parents. They also expressed fear that one of their own embryos may have been wrongly implanted in another patient or is being raised by someone else.
On January 5, 2026, the Does formally requested that the clinic help identify the baby’s biological parents and account for their remaining embryos. They allege the clinic failed to provide a meaningful response, prompting the emergency legal action.
In their lawsuit, the couple is asking the court to compel the clinic to:
Notify all patients with stored embryos,
Offer free genetic testing to children born through the clinic over the past five years, and
Fully disclose any known or suspected parentage errors.
In a statement, the Fertility Center of Orlando said it is cooperating with ongoing investigations and working with all affected parties to determine how the incident occurred. The clinic emphasized its commitment to transparency and to the welfare of the child and families involved.
