The Court of Appeal sitting in Abuja has upturned the judgement of the Nasarawa State Election Petition Tribunal, which nullified the victory of Governor Abdullahi Sule.

On October 2, the tribunal sacked Mr Sule and declared the candidate of the People’s Democratic Party, PDP, David Ombugadu, as the winner of the March 18 governorship election in the state.

Dissatisfied with the judgement, Mr Sule, through his counsel, Wole Olanipekun, SAN, asked the appellate court to upturn the judgement of the tribunal.

He argued that the tribunal refused to take the submissions of their witnesses during the tribunal hearing, adding that the BVAS data were merely dumped before the tribunal without being considered evidence.

Ruling on the appeal on Thursday, the appellate court, in a unanimous decision by a three-man panel of justices, declared that the tribunal erred in law in concluding that Mr Sule did not win a majority of the votes cast in the election.

The appellate court subsequently set aside the judgement of the tribunal and affirmed the election of Mr Sule as governor of the state.
